MarioGarage – Terms & Conditions
Version EN – applicable to all services and sales performed by MM GARAGE SAS (MarioGarage)
1. Scope of Application
These terms apply to all repair, diagnostic, paint, and vehicle sales services provided by MarioGarage. By signing a quotation, invoice, or work order, the client acknowledges having read and accepted these terms without reservation.
2. Estimates and Diagnostics
All diagnostics and estimates are subject to a non-refundable fee covering inspection time and labour. An 80% deposit is required to begin any repair. The remaining 20% balance must be paid when the vehicle is ready for collection.
3. Payments
Accepted payment methods: cash (within legal limits), credit/debit card, bank transfer, or cheque.
Invoices must be paid in full at the time of vehicle collection.
In case of late or unpaid invoices, interest will apply automatically at three times the legal interest rate, plus a €40 fixed recovery fee.
If payment remains unpaid after formal reminder, the case will be transferred to a court-appointed bailiff (huissier de justice) or to the competent court for recovery.
4. Retention and Storage Fees
Under Article 2286 of the French Civil Code, MarioGarage retains the right to keep the vehicle until full payment of all due amounts.
Once notified (verbally or in writing) that the vehicle is ready for delivery, the client must collect it within 3 days. Beyond this delay, a storage fee of €20 excluding VAT per calendar day applies.
5. Warranty
Repairs performed by MarioGarage are guaranteed for 6 months from the date of invoice, or longer if covered by a supplier’s commercial warranty (up to 24 months).
Paint and bodywork services are guaranteed for 12 months.
No warranty applies in cases of misuse, accident, or if the part has been modified or installed elsewhere.
Customer-supplied parts are not accepted and therefore not covered.
6. Responsibility and Liability
MarioGarage cannot be held responsible for pre-existing faults, hidden defects, or any damage unrelated to the work performed. Liability is limited to the invoiced amount of the concerned repair.
7. Disputes and Mediation
In the event of a dispute, both parties shall first attempt an amicable settlement.
Consumers may also contact the Médiateur de la Consommation CNPA / Mobilians https://www.service-public.gouv.fr/particuliers/vosdroits/F1822 free of charge before any legal action.
In all other cases, the competent jurisdiction is the Tribunal de Commerce de Grasse.

By authorizing any work, signing a quotation, or paying a deposit, the client acknowledges having read, understood, and accepted these Terms & Conditions in full.
